| 摘 要： | 日本共谋共同正犯理论在＂重处必要性＂和＂合法条逻辑性＂这两种理论诉求的相互较量中陷入困境。形成这种困境的原因不在于理论上没有穷尽解释性的求解可能,而在于日本共犯制度所采用的个别化处罚原则设计。在这一困境成因的启示之下,探讨参与犯处罚原则的应然设计模式非常必要。在＂个别化模式＂＂、主从关系模式＂和＂等价处罚模式＂当中,＂等价处罚模式＂显然更具合理性。

| Abstract: | The theory of Japanese collusive coprincipals is in hot water on the argument between higher punishment scale necessity and logical necessity.This puzzledom does not result from deficient theoretical explanation,but originate from the design of Japanese criminal participator's punishment principle.Such a cause tells us that it is necessary to talk about criminal participator's punishment principle.On this question,equivalent punishment principle is preferable. |
