| 摘 要： | 在中国刑法语境下,想象竞合犯处罚原则应当定位于＂从一重重处罚＂。＂从一重＂中的＂重罪＂应当采用宣告刑比较说,＂重处罚＂应将重于一罪、轻于数罪作为原则,并采用法定刑幅度中间线理论,同时,还要就轻罪的附加刑在量刑时予以考虑。此外,应当就追诉时效、亲告罪、既判力、自首、判决主文的表述等想象竞合犯的贯彻问题予以特殊关注,以便指导司法适用。

| Abstract: | In the context of Chinese criminal law,principle of punishment for imaginative jointer of offenses should be positioned in heavier punishment in the most serious crime.Heavier punishment in the most serious crime should use the theory of comparative declared criminal.Heavier punishmentshould be heavier than one punishment and lighter than several punishments and use the line theory of legal punishment amplitude.Also,when passing sentence,We should pay attention to the accessory punishment of the lighter one... |
