非婚生子女抚养涉及的法律问题：由案件生发

非婚生子女抚养纠纷反映了我国在非婚生子女抚养方面的立法不足与现实困境：立法原则不明确;婚生子女与非婚生子女二元划分不科学;亲子关系确定规则缺失;公法制度的保障不力。为切实保障非婚生子女受抚养的权利,顺应＂子本位亲子法＂的发展趋势,我国亲子立法应确立子女最大利益原则,取消婚生子女与非婚生子女的划分,建立统一的亲子关系确定制度,增设子女抚养保障措施。

The Law on the Illegitimate Children Custody：Extension from a Case

The disputes on the illegitimate children custody reflects the lack of legislation and the practical dilemma,which shows as the unclear legislation principle,the unscientific division on the legitimate and illegitimate children,the missing of the rules on the parent-child relationship and the inadequate protection from the public law system. To protect the rights of the illegitimate children and conform to the trends of the principle of the children first in the parent-child law,the law should establish the principle of children interest first,abolish the division on the legitimate and illegitimate children and establish the uniform system on the parent-child relationship and the security measures.
