| 摘 要： | 新闻侵权,从本质上说是新闻自由超出必要的限度而侵害他人的人格权,属于一般侵权行为.在我国,由于新闻事业扮演着特殊的社会角色,承担着重要的社会功能,构成侵权时,表现出若干特殊性.本文拟从新闻侵权的对象、构成要件和责任三个方面来阐述其特殊性.

| Abstract: | Media tort,essentially,is the right of personality which is damaged by the freedom of press which exceeds the necessary limit,it belongs to the ordinary tort.In China,because the jounalism plays the special social role,performs the important function,when it constitutes the tort,there are some particularities.This article will talk about them from the object of media tort,requisite and liability. |
