农业知识产权制度的审视与完善

我国农业知识产权战略已上升成为国家战略，农业知识产权制度已成为保障农业科技进步的基础性法律制度。但农业知识产权保护的制度功能并未完全发挥出来，其对农业发展的推动作用尚不突出，对加速农业现代化进程的基础性和先导性作用尚未形成。新公共服务理论为审视和完善农业知识产权制度提供了全新的视角和方法。遵循新公共服务理念，能够将对创新性涉农智力成果的保护建立在确认农业知识产权人的专有权利与平衡社会利益的基础上，并通过农业知识产权保护制度、利用制度和管理制度的完善，实现专有权利保护和社会利益平衡的充分结合。

Review and Improvement of Agricultural Intellectual Property

The agricultural intellectual property strategy has risen to become a national strategy in China, and the intellectual property system has become the basic legal system on safeguarding agricultural science and technology progress. But the agriculture intellectual property rights protection system has not fully played out. So the role of agricultural development is not outstanding, and speeding up agricultural modernization process has not been become a fundamental and guiding role. The new public service theory provides a new perspective and method to review and consummate the agricultural intellectual property system. Following the new public service concept can result in balance of proprietary rights and social interests under the realization of agricultural intelligence, and,through the agricultural intellectual property protection system, the using of system and the improvement of the management system can build full combination of the protection of patent rights and balance of social interests.
