| 摘 要： | 企业人员受贿罪存在未遂形态,其既遂与未遂的认定应以行为人是否确实索取或收受贿赂,为他人谋取利益,数额较大为标准;对该罪共同犯罪的认定,则应根据参与共同受贿的主体身份不同,分为四种情况分别加以认定。

| Abstract: | Bribery crime committed by employees of enterprises has two patterns: accomplished crime and non-accomplished crime.The differentiating criterion is up to such facts as demanding or accepting bribes,securing benefits for another person and a relatively large amount.When determining the nature of various common crimes,we should analyze the four various situations according to their subject status. |
