探析我国农村土地承包经营权的发包方

目前我国《农村土地承包法》、《土地管理法》和《物权法》对农村土地承包权的发包方采取的都是概括规定的方式，缺乏详细具体的法条，因此在实际运用中产生了一些问题，如村委会行使经济职能是否具有合理性、村民小组是否是民事主体等。针对以上两大主要问题，结合法条和实际我们提出了一些完善发包方的建议和看法，希望对于解决实际问题有所贡献。

An Analysis of the Party Issuing Contract of Rural Land Contractual Management Right

In the Rural Land Contract Law,Land Management Law and Property Law,all rules concerning the party issuing contract are regulated in a general pattern,being lack of detailed and specific articles,therefore they bring about a number of problems in practice such as the justification of village committee’s economic function,or whether the small village group can be regarded as civil subject.In terms of the above two issues this article proposes corresponding suggestions in the purpose of helping to solve the problem.
