刑事精神损害赔偿制度的价值及建构

文章以分析实证主义为研究方法，分析了刑事精神损害赔偿在司法现实中运行现状并进行原因解析，指出法律的逻辑秩序与法律的实践秩序间存在冲突，认为在实现公法目的与维护私益之间应保持一定平衡。同时从多个维度研究刑事精神损害赔偿制度构建的内在价值与功能。最后通过对“四个关系”的思考，着力构建权力具有内敛性、法律体系具有逻辑性、制度具有可操作性和实效性的、社会主义特色的刑事精神损害赔偿制度。
