构建国际和谐社会:国际法上的人本秩序

在国际法上建构人本秩序是国际法发展的重要倾向,也是人类社会发展的需要。与传统国际秩序追求相比,它体现着更高级别的正义。当前,国际法的许多新发展正在昭示着国际社会对人本秩序的肯定性态度。由于人本秩序关注的是国家主权范围内的“人”,因此它会与国际法中的国家主权原则发生冲突。但这个矛盾不能否定人本秩序作为国际法的价值取向。

On the Humanism Order in International Law

Compared with traditional pursuit for peace and safety in international law,humanism order embodies better justice.For those years new developments of international law indicate that humanism order is recognized and agreed in international society.But it perhaps conflicts with state sovereignty because it pays attention to persons who are subordinate to state sovereignty.Although the conflict couldn't deny humanism order,we have to face all the problems.
