| 摘 要： | 占有制度在物权法中的地位主要有三种:辅助地位、平等地位和基础地位。但在现代物权法中,占有制度应居于优越地位,这不仅是占有功能、功效的逻辑体现,也是财产利用创造巨额财富和弱者保护等社会现实的需要。

| Abstract: | The possessory right mainly has three kinds of role in the real right law: assistant role,equal role and foundation role.But in modern real right law,the possessory right should be in the superior position,which is not only the embodiment of the logic of the function and effect,but also the necessity of protecting the huge treasure and the weak. |
