高校学生管理行为侵权的法律问题研究

高校管理是维护学校秩序、保障学校生活良性运行、培养高素质人才的重要条件。然而由于高校与学生的关系问题、高校管理权的性质问题没有定论诸多原因,使得高校在其管理中侵犯大学生权利的现象时有发生,大学生状告学校侵权的法律纠纷也呈上升趋势。当务之急是迅速健全法律法规、规范管理、完善救济渠道,以切实保护学生的合法权益。

A Study of Legal Questions on Administrative Behavior Tort of College Student

Administration is necessary for universities and colleges to keep school order, guarantee school life and train high quality students. Some reasons, such as the relation between school and students, and the uncertain nature of administration power, cause many infringing acts in the process of administration. There are more and more disputes that student accuse schools of tort. The urgent thing is to quickly amplify rules and regulations, normalize administration and improve relief channel in order to protect student' s legitimate interest.
