| 摘 要： | 非物质文化遗产是一个国家的民族特性和民族精神的重要载体,它可分为以大脑为载体和以物质为载体两大类;非物质文化遗产蕴含着丰富的权利价值和人文精神,体现了一个民族或国家独特的自然观、宇宙观和社会观,因而与一个民族或国家的历史和未来有着密不可分的关系。由于我国立法特别是刑事立法的缺失,破坏非物质文化遗产的现象十分严重。为了匡正严重破坏非物质文化遗产的行为,遏制破坏非物质文化遗产现象的蔓延,必须检讨我国有关刑事立法的疏漏,完善我国刑法抗制犯罪的机能。

| Abstract: | Non-material cultural legacy is an important vehicle of national traits and spirit.The legacy is of two types,one is with the brain as vehicle and the other with the material as vehicle.Non-material cultural legacy contains rich right value and humane spirit and reflect a nation's unique views on nature,universe and society.Therefore it is closely related with a nation's history and future.Damage to non-material cultural legacy has been serious due to lack of legislature especially lack of criminal law legislature.We should try to find out what is lacking in the criminal law legislature in our country and improve the function of the criminal law against crimes so as to stop those behaviors that damage non-material cultural legacy and crack down on the rampancy of non-material cultural legacy damage. |
