论国际贸易下知识产权的约束机制

知识产权双边和多边保护协定的达成体现为知识产权输出国以贸易和投资优惠待遇作为筹码，进行体制转移．对知识产权输入国施加的私权保护的高标准。为了抗衡知识产权多边协定，尤其是TRIPS对发展中国家公共健康和人权问题造成的负面影响，非政府组织协助发展中国家也以体制转移的策略，将知识产权问题带入人权领域的国际公约进行约束。

Regulations of Intellectual Property Rights under the Framework of International Trade

The bilateral and multilateral agreements on intellectual property rights reflect that the IP exporting countries shift regimes and use trade and investment preferential treatment to exchange for high standard of private right protection on IP importing countries. To resist negative effects on public health and human right is- sues of developing countries caused by the multilateral agreements, especially TRIPS, NGOs assist the developing countries to adopt the shift regime strategy as well, bringing the intellectual property issue into international human right convention for regulation.
