论法官职业化背离民主的倾向性

无论是英美法系国家任命制下的法官，还是大陆法系国家的职业法官，其初衷都是以非民选的方式为基础，这却在一定程度上造成了其与“民主”之间的“紧张”关系。如何解决这一“紧张”关系，有效的途径即是从社会、民众的角度加以调整。对我国的法官职业建设而言，也应注意这个问题。
