富士康“数连跳”事件的法律思考

摘    要:富士康"数连跳"事件引发了社会各界的关注和反思,反映出经济转型下的中国一个突出的社会问题,更是一个法律问题,即如何保障劳动者安全健康权。目前我国对劳动安全健康权的立法上重于"经济性",缺乏"社会性",偏向以安全生产,促进经济发展为主题,缺失以人为本的终极关怀理念,忽视劳动者心理健康。我国应完善有关保障劳动者安全健康权的立法并严格执法,督促用人单位切实承担起社会责任,同时改革工会职能,加强劳动者心理健康培训,使劳动者有尊严地生活,体面地劳动。

Abstract:The incidents of continuous suicide by leaping over the building in Foxconn have attracted the attention and reconsideration of the community,have reflected the social problem in China in her social transformation phase,and have been a legal issue: how to ensure the right for security and health in the part of the laborers.At present,China's legislation on the right for security and health stresses partially on "economical efficiency" lacking "sociality";pays special attention to the subject of safety in production to promote economic development,lacking the notion of ultimate care on the basis of human orientation,and neglecting the psychological health of the laborers.China should perfect her legislation and strict implementation on guaranteeing the right of security and health in the part of the laborers.The employers are to be urged to undertake their social responsibilities,to reform the function of their labor union,to strengthen the training in psychological health in the laborers,to ensure their dignified life and respected work.
