思想史视域下的清代调处息讼制度解析

清代调处息讼制度在清代纠纷机制解决研究体系中地位重要,得到了学界极高的关注,但既有的研究在考察调处制度的基础上关注经济层面过多,对精英群体的理念与叙述过多关注,忽视精英秉持的意识与民众意识之间的关系。因而,在对既有研究进行思考的基础上,将清代调处息讼制度整体纳入思想史的视角之下,意在体现一种不同的研究视角。文章从历史基础溯源、社会结构基础及思想文化考察三个角度为出发点,并着重考察在传统社会中生成的调处息讼意识是如何由社会精英知识分子向普通民众间传播的。

An Analysis on the Mediation System in Qing Dynasty in Terms of the History of Ideas

Mediation system in the Qing Dynasty has a leading position in solving the disputes mechanism,and the scholars also pay highly attention.But the current research gives much attention to economic aspect and ideas and narration of the elite groups while ignoring the relationship between the elite awareness and public consciousness.It is a different studying perspective to put the mediation system in Qing Dynasty into the field of history of ideas aiming to show a wholly new pint of view.Starting with the history,social structure and thought culture,this paper intends to probe into the spreading ways of mediation system awareness produced in traditional society from elites to commonplace.
