| 摘 要： | 我国学者关于社会危害性与法益两个概念的认识并不统一,导致对于两个概念的使用比较混乱,争议也比较大。两个概念之间的关系并非水火不容,完全可以各司其职、相互配合,在我国的犯罪论体系下发挥各自的作用。

| Abstract: | Scholars don′t reach an agreement on the two concepts of social harmfulness and legal interests,they arouse great disputation about the use of the two concepts.The relationship between the two concepts is not incompatible but cooperative.The two concepts could play their respective roles in criminal theory system. |
