论网络交易平台提供商的民事法律责任

网络交易的形式多种多样,网络交易平台起着联系销售者和消费者的桥梁作用.第三方提供网络交易平台的模式引发的纠纷也层出不穷,问题的焦点集中在平台提供商的民事法律责任需要明确.对于这一问题,大致存在"卖方"或"合营方"说、"柜台出租方"说、"居间人"说以及"网络平台提供商"说.这四种观点都有一定的合理性,但本文认为首先平台提供商应当承担由约定义务产生的责任,至于平台提供商还应当承担其他什么样的民事责任是受服务关系和交易关系之间的联系以及网络环境的特殊性两方面的影响.对于这一问题,行业自律规范是一个解决的良好途径.

Models of online transactions vary differently.However,the model of the third-party-provider that is the third party who provides online transactions gives rise to problems.All these problems are focused on the civil liability of providers of online transactions.There are four kinds of theories on this civil liability.But in the author's opinion,the online transaction provider should first hold the liability according to the contract signed with users.And if there are other liabilities,they are largely influenced by the connection of service and transaction and the characteristic of the Internet.The self-disciplined rules are a kind of good solution to this problem.
