| 摘 要： | 国家侵权之精神损害赔偿责任已得到社会各界的基本认同。国家精神损害赔偿责任是国家有责性的逻辑延续和现代法治精神的价值确认。认定国家精神损害赔偿责任应当考虑行为主体、履职期间、违法行为、发生损害结果、违法行为与损害结果具因果关系五大要件。国家精神损害赔偿金额应当有一定的判断标准,立法中可借鉴学界之一般精神损害等级思路以及法国的司法实践经验,确立一般性与特殊性相结合的精神损害赔偿金额计算模式。 |

| Abstract: | The spirit damage compensation for the country tort has been the basic identity.The spirit damage compensation is the logical continuation of state responsibility and value confirmation of the modern rule of law.For Identifying responsibility,infringer,performance during their duties,tort,the result of injury,causal relationship between the result and tort must be considered.State compensation for spirit damage should have a certain standard.We can learn from the general spirit of the damage level of academic ideas and the experience in legal practice in France to establish a spirit damage compensation calculation mode with the combination of generality and specificity. |
