《矿产资源法》的修改：以增强政府公共服务性为导向

随着中国市场经济体制的不断完善,带有浓厚计划经济色彩的现行《矿产资源法》已与当今社会经济发展不相适应,其以行政管理为核心的计划性、管制性模式正严重制约着中国矿产资源战略的实施,不利于矿产资源战略的可持续发展。在《矿产资源法》的修改中,如何体现政府职能由单纯行政管理向增强公共服务的转变,是《矿产资源法》能否适应当前社会经济发展的关键,政府在矿产资源管理中的角色从以行政管理为主导向增强公共服务性发展是亟待修改的《矿产资源法》基本的价值导向。

Preliminary Recommendation on the Revision of Mineral Resources Law: Improving of the Public Service-oriented Government

With the progressive pace of socialist marketing economy in China,the Mineral Resources Law with the character of planned economy has not adapted to the contemporary development of social economy.The planning and regulating model centering the administrative governance has been imposing deep restrictions on the implementation and the sustainable development of the mineral resources strategy.During the revising process of the Mineral Resources Law,the transformation from administrative governance-oriented government to public service-oriented government is the key point for the purpose of adaption to the contemporary development of social economy.The role of the government in the mineral resources governance should be transformed from administrative governance to public service,which is the fundamental value orientation in the revising process of the Mineral Resources Law.
