| 摘 要： | 情势变更原则是现代合同法中的一项重要原则,中国已经是世界贸易组织的成员,解决我国法律与WTO规则及国际通行情势变更原则规定的衔接工作,已经势在必行。本文通过对情势变更原则的概念、理论沿革和理论依据的探究,结合国内外现实情况,对该原则的适用条件以及与若干法律概念进行分析比较,并对相关民事立法工作提出一些建议。

| Abstract: | The principle of the change of circumstance is one of the important principles of modern contract laws. China has entered the WTO, and this entails that our national laws should harmonize with the WTO rules and the international customs related to the principle of the change of circumstance. The focus of this paper is on the concept, the evolution and the theoretical resources of the principle of the change of circumstance. Based on inner and exterior situations, the paper analyzes some application conditions of the principle, compares some related legal concepts and finally puts forward some suggestions on relevant civil legislations. |
