| 摘 要： | 刑法规定表明似乎所有犯罪的未遂行为都应以未遂犯论处。从经济学依据看,这与刑法的谦抑性价值相违背;从法哲学依据看,也与犯罪本质、刑罚功能相排斥。未遂行为包括罪与非罪两种情况,对此刑法必须作出明确且具有可操作性的规定。国外刑法中的“综合主义”和“列举主义”可供我国借鉴。

| Abstract: | Criminal law stipulate is it seem all abortive behavior of crime should punish with abortive one to indicate, by the look of economics basis, this is violated with modest restraining value of criminal law ; From France's philosophy according to looking, repel with crime essence , penalty function too. The abortive behavior includes the crime and not two kinds of situations of crime, must make clearly and have effective regulations." Comprehensive doctrine " and "enumerating the doctrine" in foreign criminal law are suitable for our country's drawing lessons from . |
