| 摘 要： | 我国法律对刑事非法证据排除制度相关规定存在严重的不足,主要表现为对非法证据排除规则的规定过于简单、笼统。欠缺禁止非法证据的最重要的、切实可行的、具体的排除规则和制裁。因此,借鉴国外对非法证据排除制度的相关规定,并结合我国现阶段的实际情况,来完善我国的刑事非法证据排除制度具有重要意义。
