在法治发展新阶段振兴我国的法律职业伦理——以“中国特色社会主义法律体系已经形成”为研究视角

"中国特色的社会主义法律体系已经形成"总体上解决了有法可依的问题,我国法治建设的主要任务将更多地转移到有法必依或者说法律实施上。法律职业者是法律实施的中坚力量,法律职业伦理对于职业者素养的提高具有重要的作用,法治发展新阶段热切呼唤法律职业伦理的振兴和法治信仰的确立。在制度建设取得成就的同时,法律职业伦理滞后导致的司法渎职和腐败问题已成为法律实施的严重障碍。在新的时代条件下振兴我国的法律职业伦理,面临着"理论基础—制度规范—体制设计—机制运行"四位一体的研究架构和实践任务。

Enhancing the Legal Professional Ethics at the New Stage of Rule of Law:From the Perspective of "the Establishment of Socialist Legal System with Chinese Characteristics"

The establishment of the socialist legal system with Chinese characteristics marks a new era—the"perfecting and implementing stage of rule of law".Its historical task calls for the prosperity of legal professional ethics which plays an important role for the goal of the new stage.Although we have made great achievements in enacting law,the judicial corruption caused by the lack of legal professional ethics has become a great obstacle for law enforcement.To promote the ethics,we face the mission to build a research framework integrating"theory,regulation,institution design and operational mechanism"and put it into practice.
