小区车位和车库权属研究

摘    要:《中华人民共和国物权法》第七十四条试图结束开发商和业主之间车位和车库权属纷争,但表述模糊,无可操作性。从车位和车库的区分界定以及物权理论来看,车位应归业主共有,车库作为独立的物权客体可以归开发商或者业主所有,但是车位和车库的产权无论归属于谁,都应当"首先满足业主的需要"。这里"首先满足"是指优先使用、购买和租赁等权利。

Abstract:According to the 74th Item of Property Law,the argument between the developers and the owners seems to end up.But,its statement is vague and it is lack of the possibility of being operated.With regard to the differentiation definition on parking stall and parking garage and the theory of property rights,parking stall should be shared by all the owners,and parking garage,as an independent object,belongs to the developers or the owners.However,whoever the ownership belongs to,it is necessary to firstly meet the needs of the owners,which means priority of use,purchase and lease.
