公共健康与公民自由：张力与平衡——建立在美国公共卫生案例分析的基础上

“集体”导向的公共卫生干预理念主张在公共健康和公众福利受到威胁时公民的基本自由权利应受到必要的限制，而“个人”导向的公民自由理念主张在俗世社会中任何行动的权威只能来源于有行为能力的道德主体的同意。两种观念的对立反映出在公共卫生领域中长期存在的公共健康与个人自由之间的张力。在公共卫生领域，我们应该将公共健康放在优先位置，同时应该用“人的生命尊严”作为边界限制。
