| 摘 要： | 法律移植是中国法律现代化的一个重要的手段和方式.文章明确论述了中国法律移植应遵循的基本原则,即科学性,合宪性和法制统一性,变通性和适时、适量、适度的原则.同时结合中国法律实践对中国法律移植的主体的专属性,法律移植权的归属进行探讨.
