| 摘 要： | 本文在对教唆犯各种理论学说分析论证的基础上,提出"教唆行为是一种犯罪预备行为,教唆犯的实质是利用有意志的工具"这一全新的理论,并运用这一理论科学地解决了教唆犯的犯罪形态及其性质问题,且化解了传统教唆犯理论上的必罚性与传统实践中的不罚事实之间的矛盾。

An Independent Re-interpretation of Abettor and Analysis of Its Feasibility |

| Abstract: | After analyzing all kinds of theories about abetment, this paper puts forward a new view that abetment is in nature a kind of preparation for crimes and the characteristic of an abettor is to use the willing tools. The view reasonably solves the problem about abetment of the consummated and attempted formation, which is expected to have the theoretical and practical significance for the judicature. |
