农民享有平等社会保障权的法律和现实依据

根据现行宪法和中国已加入的国际公约的规定，公民应享有平等的社会保障权，但在现实生活中，农民因身份不同，在社会保障方面的现实权利上与城镇人口存在着很大差距。农民是国有资产的投资者和所有者，理应享有所有者权利，而现存的城乡二元化结构限制了农民享有平等的社会保障权，这是与社会主义和谐社会的构建极不相容的。因此，建设城乡统一的社会保障制度，给予全体农民以与城市居民平等的社会保障权，是发展市场经济与建设和谐社会的必然要求。

The Legal and Pragmatic Basis for the Farmers' Equal Social Security Right

According to the constitution of the People＇s Republic of China and the effective conventions therein, every citizen should enjoy equal fight of social security. But in reality, a peasant has much less such fight than an urban dweller jut because of their different Hukou. Farmers are part of the investors of state-owned property and should have owners＇ fights. It is against our founding of a harmonious social society that the existing two-lateral social frame limits peasants＇ fights. Therefore, to establish a uniform system of security fights, making all citizens enjoy it equally, is a requisite to accelerate market economy and to establish a harmonious society.
