摘    要:随着经济的发展 ,劳动争议日益突出。现行劳动争议处理体制已经难以适应新的形势。我国劳动争议处理体制必须改革。借鉴世界主要国家的经验 ,比较我国学界的几种观点 ,选择和重建我国的劳动争议处理制度 ,形成注重调解、裁审分离、各自终局的新体制 ,是非常必要的

Abstract:With the development of economy ,labor dispute become s more and more conspicuous in China.The existing system for settling labor disput e is hard to meet the economic situations It is essential to rebuild a new syste m.First ,the corresponding system of those leading states in world are referred. Then ,the major points on settling labor dispute system in China are analyzed an d compared.We select and establish a new system in China ,which strengthen the c oncilispution of labor dispute .It is the most important in this system that arb itration coming form arbitration commissing and judicial proceedings are indepen dent ;Moreover, their decisions are final.In order to perfect the new system ,so me measures must be taken.
