不道德的背反：论法治本土资源论与道德理性之博弈

现今中国，法学新观念涌现不断。关于法治资源的取舍，争论甚烈。民族法、民间法等各逞其能。缺乏深度理性思考的新观念不仅造成了法学研究的虚假繁荣，更为严重的是，一些精巧的专制、人治观念乘乱涌入，大肆侵蚀法治之基础，威胁法律信仰的建立。这对中国法制进步为害匪浅，故有必要正本清源，厘清语境，以道德理性之自觉来重建法治资源问题探讨的基础。

An Antinomy of Immoral: on the Rule of Law,Local Resources, Game Theory and Moral Reason

In today＇s China, new concepts of law emerge very frequently. Choice of resources on the rule of law, the argument is very strong. National law, civil law, and other major shows off their best. New theories lack of thinking in depth,are not only led to the false prosperity of legal studies, more seriously, make some ingenious tyranny, the rule of man concept influx of big ero- sion of the rule of law based on threats to faith in the law building. This is a progressive damage greatly on China＇s legal system,so it need to radical reform,to clarify the context,and by the way of the rational moral self-conscious to rebuild the basis to explore the resources for the rule of law.
