关于完善老年人再婚自主权益法律保障的相关对策

随着家庭养老功能的弱化，大部分单身老年人有再婚的需求。为避免老年人因同居或再婚而使人身或财产权益无法受法律保障，我国应对老年人再婚自主权益法律保障进行进一步的完善。具体做法是通过在《婚姻法》中设立老年人同居制度、增加约定财产制内容条款，并强化司法执行措施，从而达到真正维护老年人再婚自主权益的目的。  

On the Improvement of the Countermeasures for the Legal Protection of Old People's Independent Rights for Remarriage

As family endowment functions weakening, most single elderly people want to remarry. In order to aviod the situation that the personal or property interests of elderly people can not be protected by the laws due to cohabitation or remarriage, China should furtherly improve legal protection of elderly people's remarriage independent rights through establishing a system about elderly people's cohabitation and adding rules and regulations to protect their property in the Marriage Law, reinforcing judicial execution measures. Thus, we can reach the goal of protecting elderly people's remarriage independent rights.
