| 摘 要： | 介绍了电子合同的概念,研究了电子合同当事人的行为能力对电子合同法律效力的影响,认为我国现行法中当事人行为能力的规定应适用于电子合同,并且可以利用电子签名和电子认证判断当事人的行为能力,确保电子合同具有法律效力。

| Abstract: | This paper introduces the concept of electronic contract, and discusses such topic as authentication and validity of the parties' capacity of action. The author thinks the regulation of party's capacity should apply to the electronic contract in the current law and should utilize electronic authentication and electronic signature to judge the party's capacity to guarantee the legal effect of electronic contract. |
