北京市村民自治地方立法研究

地方立法为北京市村民自治提供了重要的制度规范 ,但还存在一些有待改进的问题 ,主要表现在地方立法的整体性推进稍显滞后 ;有些法规可操作性不足 ;规约不规范、形式化等。对此 ,本文提出了以下改进意见 :丰富村民自治的地方法规类型 ;提高法规制定主体的层次 ;细化关键性的程序 ,增强地方立法的可操作性 ;提高村级规约的水平。

A Study on Local Legislation for Village Autonomy in Beijing

Theres still room for the improvement in local legislation for village utonomy in Beijing,e.g. the slow integral development for village autonomy, the low level of the main legislative bodies,insufficient practicability of some regulations,non-coverage over some key procedure issues,formalism and lacking of canons in the making of village-level stipulations of agreement etc. Therefore,the following measures should be taken: diversifying the types of local legislative rules;raising the level of the main legislative bodies;perfecting key procedures and increasing the practicability of local legislation;raising the level of village-level stipulations of agreement.
