| 摘 要： | 建设工程优先权是优先权的一种,由于我国民法没有对优先权制度进行完整规定,目前建设工程优先权体现在《合同法》第286条。从建设工程优先权的定性、登记与建设工程优先权产生的时间和建设工程优先权的功能来看,本文认为建设工程优先权具备了立法基础,应纳入统一的优先权民事立法,并对建设工程优先权的立法提出具体构想。

| Abstract: | The Construction Project Priority is one kind of Priority. Since there is no complete stipulation on Priority in the Civil Law of PRC, the Construction Project Priority can only be seen in Clause 286 of the Contract Law of PRC. From its nature, registration, forming time and function, Construction Project Priority is believed in this essay to have the foundation of legislation and therefore should be brought into the uniform civil law of Priority. Specific clause recommendations are presented for the legislation on Construction Project Priority. |
