邪教的法律性质及其治理创新

邪教是一种古今中外皆有的特殊宗教现象,具有深刻的意识形态性。在当前的形势下,需要从历史考察与现实讨论、学理分析与比较研究相结合的角度,对什么是邪教、如何认定邪教的法律性质、怎样依法治理邪教组织及其活动、在法治中国语境下如何推进反邪教治理体系和治理能力的现代化等问题作出解答。基于治理现代化的视角,在参考世界政教分离国家预防和治理邪教的制度规定与法律适用经验的基础上,提出反邪教治理体系与治理能力创新的五项建议。

The Legal Nature of the Destructive Cult and Its Governance Innovation

Destructive cult is a special religion phenomenon existing at all times. It has profound characteristic of ideology. In the current situation, we need to answer a series of questions： What is the destructive cult？ How to identify the legal nature of the destructive cult？ How to govern the destructive cult and their activities by law？ How to promote the modernization of governance systems and governance capacity of anti-destructive cult under the law in China？ The prospect should connect the points from the study of history and reality discussion, theoretical analyses and comparative studies. And from the perspective of modern governance on the base of the provisions of law applicable to the prevention and management experience in the process of governance destructive cult in the separation of church and state, the author points out five recommendations concerning the modernization of governance systems and governance capacity of anti-destructive cult.
