互联网领域“公认的商业道德”的司法适用

摘    要:公认的商业道德是不依附于诚实信用原则的独立法源?作为造法规范,诚实信用原则和公认的商业道德是相互分离且相互独立的?在适用次序上,公认的商业道德优先于诚实信用原则?法院对于某项规则是否构成公认的商业道德?能否提起上诉等问题均享有自由裁量权?法院通过适用公认的商业道德,借助诉讼程序实施其价值评判,可在避免直接对实体性争议予以抉择的基础上解决纠纷?

Abstract:As one kind of legal resource, accepted morality that relates to business does not depend on the principle of good faith. It has precedence over good faith principle when supplementing the legal loopholes of statute. Judges should exercise discretion over the qualification of accepted morality that relates to business, and limits on appeal. Accepted morality that relates to business offers the procedural technique for resolving disputes in order to avoid direct choices between various values.
