| 摘 要： | 自由开放的网络击碎了传统社会的信息垄断和以此为基础所建立起来的一整套政策以及法律制度；网络是虚拟性的，而此前人类的一切法律制度都是建立在物质世界的基础上的；失去了地理疆界后的法律也失去了将人和物加以“定位”管理的依据；行为效果即时性与动态变化考验法律的权利救济制度；海量的多元的信息加大了法律对监管人责任设定的难度；为网络立法就是为发展中的技术立法。
