票据签章各种形式的有效性探讨

我国《票据法》把签名、盖章或签名加盖章作为三种法定的票据签章形态,而且对三种规定相当严格。自然人的姓名必须是本名,法人的签章必须是法人的印章加法定代表人或其授权的代理人的签章。文章建议无论对法人还是对自然人的签章都应该从有效性原则出发,从宽解释,并对实际业务中的各种签章形式的法律效力进行了探讨。

About the Validity of the Various Forms of Signature on Negotiable Instruments

According to China's Law of Negotiable Instruments,signature,signature sample or signature and sample are three valid forms on negotiable instruments.In this regard,strict rules of signature are imposed.The signature of natural persons should be in the form of their real names,and that of legal persons should be in the form of their samples and their representatives' or agents' samples.It is suggested that the rules concerning this should be more flexible.This paper also atempts a probe into several forms of signature and their validity in practice.
