交通事故纠纷解决的行政机制研究

摘    要:以对一个城市交警大队的调查为基础,展示交警解决交通事故纠纷的概况、程序,并从微观层面分析交通事故纠纷解决过程中各方主体的角色与功能。基于对这一纠纷解决机制的价值合理性与目标合理性之评判,揭示了交警解决纠纷职能的内在价值冲突,确证了其形成与发展的现实根据。从久远的前景看,我国交通事故纠纷的主要解决方式必然过渡到法院诉讼与社会保险;但在当下,以行政权力解决纠纷应当是一个较为合理的应对机制。

Abstract:According to an investigation of a traffic cops team, the authors reveal the general situation and specific procedure of resolving disputes caused by traffic accidents, analyze the roles and functions of every party in the resolution of traffic accidents, disclose the internal conflict in the function of traffic cops' dispute-resolving by judging the rationality of value and target of this dispute resolving system, and confirm the actual bases of formation and development. In the future, the main method of resolving traffic accident disputes will surely be replaced by litigation of court and social insurance. But at present, it is a relatively rational system to resolve disputes by executive power.
