摘    要:安乐死并不违背现代伦理道德和人道主义原则,具有社会伦理上的合理性;同时,实施安乐死的行为不构成犯罪,在法律上具有非犯罪性。因此,安乐死合法化在理论上具有可行性。但是,安乐死并不单纯是一个理论问题,更是一个具有极强社会实践性的问题。讨论安乐死不能脱离现实社会中各种因素的影响以及理性与情感的关系。所以,安乐死立法宜循序渐进。

Abstract:In social ethics,it is reasonable to enforce mercy killing,which doesn't violate against the principles of modern morality and humanity.At the same time,it doesn't constitute crime,being non-criminal in law.Therefore,from the perspective of theory,it is possible to make mercy killing lawful.But enforcing mercy killing is more practical than theoretical,the discussion of which cannot break away from the influence of various elements in society and the relationship between rationality and emotion.In a word,the legislation of mercy killing is suitable for gradualness.
