| 摘 要： | 最近全国人大常委会高票通过的中华人民共和国企业破产法规定了直接适用范围和限定了参照适用范围。直接适用范围为国有企业、集体企业、三资企业、私营企业以及按公司法设立的有限责任公司和股份有限公司的破产,其参照适用范围包括合伙企业,会计师类专业服务机构,农民合作社,民办高校的破产。

| Abstract: | A law is limited by the given legal relations adjusted under specific conditions rather than all kinds of economic and social relations in any case.The scope of legal adjustment is defined by the limits of certain economic and social relations.The breadth of the range of insolvency laws will influence directly the depth and width of adjusting both internal and external credit and debt relations. |
