城市公用事业管理法律问题分析

在市场经济的大背景下,我国城市公用事业正处于逐步市场化的过程中。与此相适应,城市政府在这一领域必须实现管理模式的转变,必须实现以法律手段、经济手段为主,行政手段为辅的转变,公用事业的管理与服务都应纳入法治的轨道。因此,必须提高城市公用事业管理的立法层次、完善基本法律制度、尤其是监督方面的法律制度,才能保证城市公用事业管理取得最佳绩效。

A Study of the Legal Affairs of the Management of Urban Public Service

With the market economy in background, the urban public service is in the process of gradual commercialization. To adapt to this situation, the government should change the mode of management of urban public service. Specifically speaking, the government should adopt legal and economic measures as the major means and administrative measures as the auxiliary means for the management of urban public service, and put the management of urban public service onto the legal track. Therefore, it is important and critical to study the law system of management of public service. This paper points out that the level of legislation about service and the principle of that legal system, especially the one for supervision, should be improved in order to achieve the best performance in the management of urban public service.
