虚假诉讼人法律责任分析

近年来，司法实践中虚假诉讼现象的大量出现，是《民事诉讼法》增加112和113条的直接原因。但《民事诉讼法》的规定并未完全解决虚假诉讼人的法律责任承担问题，为了全面遏制虚假诉讼的出现，立法必须清楚地界定虚假诉讼行为的违法和侵权的性质，并对虚假诉讼人施以相应的民事责任和刑事责任。

The Legal Liability of False Litigants

The emergence of a large number of false lawsuits in judicial practice in recent years is the direct cause of the in-creased provisions No. 112 and No. 113 in the Civil Procedure Law. However, the Civil Procedure Law does not solve completely the legal liability problems that false litigants assume. In order to curb false litigation, legislation must clearly define the unlawful and tort nature of false litigation, as well as the corresponding civil and criminal liability that false litigants should assume.
