| 摘 要： | 通过对正史中十三篇《刑法志》的研究，揭示出其中隐含的儒家价值情节，具体而言表现于四方面：一是十三篇《刑法志》中大量引用儒家经典和儒家学者的言论；二是儒家“德主刑辅”的德刑观贯穿于十三篇《刑法志》的始终；三是十三篇《刑法志》依循于儒家亲亲尊尊的伦理原则；四是十三篇《刑法志》均秉持儒家价值理想以批判现实和历史。
