论WTO体制下中国反倾销法律制度之完善

《中华人民共和国反倾销和反补贴条例》作为反倾销方面的专门法规 ,填补了我国反倾销方面的立法空白 ,且为遭受外国产品倾销损害的国内工业提供了寻求救济的办法。其规定与WTO要求基本一致 ,但立法体系不尽合理 ,立法内容较为原则。市场经济的发展与WTO的加入需要一部系统而完善的反倾销法。因此 ,该文提出WTO体制下如何完善中国反倾销法律制度的的具体建议。

On the Perfection of Law System of Counter- Dumping of Goods in China Under the System of WTO

As a special law of counter-dumping of goods,"counter-dumping of goods and the rules of Counter-allowance of People's Republic of China"fill in the gaps in legislation in counter-dumping of goods. In our country it provides us with a way of searching for relief for domestic industry encountering the losses from the dumping goods abroad. The regulations meet the demand of WTO, but the system of legislation is not reasonable yet, its content too much of principle rather than of applicable rules. The development of market economy and the accession to WTO need a systematic and perfect law of counter-dumping of goods. So, Some suggestions are put forward in this article, such as how to make the law of counter-dumping of goods perfect in China under the system of WTO.
