农村私有房屋买卖合同的效力认定与法律适用

摘    要:农村私有房屋买卖合同采取何种形式、登记与否不影响其法律效力。出卖依法自建的房屋,即使尚未取得房屋产权证书,也不影响合同的法律效力。夫妻一方擅自出卖夫妻共有房屋,应属无权处分,但他人有理由相信其为夫妻共同意思表示的除外。在目前没有法律、行政法规禁止的情况下,城镇居民购买农村私有房屋的合同不宜认定无效。

Abstract:Which form to take,register or not,in the sale of private house in countryside has no effect on its validity.Selling houses built lawfully,even without letter of title,also has legal effect.It is an invalid deal for either husband or wife to sell the house of co-ownership without the approval of the other unless there is reasonable belief of their common will.The agreement of purchasing private houses in countryside by citizens both city or town should not be taken invalid when there is no law or regulation.
