| 摘 要： | 英美法系和大陆法系对动产物权客体种类和范围的规定虽有较大差异,但已呈现出渐趋融合之势,从动产物权客体日渐多样化的角度可以说明国际私法领域对动产物权问题的立法和司法日趋复杂和深入。

| Abstract: | This dissertation studies in the subject-matters of real rights in movables by comparing Common law legal family with Civil law family, and points out that the two systems have becoming merged together although the laws made about the type and scope of the subject-matters of real rights in movables are so different in them. From the variety of the subject-matters of real rights in movables, a conclusion can be reached that legislation and judicature about real rights in movables in private international law have being deepened and become complicated. In addition, the authors also consider and review the relevant laws of China and put forward some suggestions. |
