法律文化与中国死刑之存废

在全世界一百余个国家已经废除死刑的情况下,在世界刑罚逐步走向轻刑化的背景下,中国的死刑何去何从?文章并没有直接回答这个问题,而是从法律文化的角度出发,尤其是从中西法律文化比较的角度,谈了对于中国民众来说,阻碍中国死刑废除的因素。加强法律文化建设,转变国人法律实践活动的价值基础,努力消除普通民众中存在的复仇意识,提高公民尊重权利,特别是尊重生命权的法律意识,才能够为中国由逐步限制死刑到最终废除死刑打下基础。

Legal Culture and the Retention and Abolition of Chinese Death Penalty

Under the circumstance that over a hundred countries have done away the death penalty,and against the background that the penalty in the world is becoming less severe,what course the Chinese death penalty will follow?Instead of directly answering this question,this paper,from the angle of legal culture,particularly from the comparative angle of Chinese and Western cultures,discusses the factors that hinder the abolition of death penalty in the eyes of Chinese people.Finally,it concludes that only by enhancing the construction of legal culture,changing the value basis of Chinese peoples legal practice,trying to eliminate the revenge consciousness of the average people,improving the legal awareness of respecting the citizenship,esp.that of respecting the right to life,can we lay a foundation for China to fulfill the transition from gradually restricting the death penalty to eventually abolishing it.
