论市场经济条件下我国的民族法建设

民族法是处理民族关系、解决民族问题的重要保障，对民族法法律地位的合理定位将有助于民族法的发展。在我国传统法学中，民族法一直处于宪法的次部门法地位，但实际上民族法具有独特的调整方法和独特的价值追求，且目前民族法法律体系已初步形成，民族法在现代社会中的作用日益受到重视，使其能够而且应该成为一个独立的法律部门。民族法虽巳形成了以民族区域自治法为主干的结构体系，但民族法的建设远未完备，在市场经济条件下进一步加强民族法建设是十分必要的，主要应从加强经济性立法，教育性立法，以及树立其权威性、强制性入手完善民族法。

On Construction of the Nationality Law under Market Economy Condition in China

The nationality law is an important ensurent dealing with relations, solving contradictions among the nationalities. The rational orientation for its legal status would be helpful to developing the nationality law. Within the traditional law science in china, it has been on the footing of secondary branch law in the state constitution. But in fact it possesses its unique regulation method and its distinctive worthiness seeking, and at present its law setup has formed initially, its function has ever been stressed increasingly in our mordern society so that it can and should become one distinctive law branch. Though it has formed its structure system with the mainstay of the regional national autonomy law, the building of nationality law is far from perfecting. It is necessary to further strengthen construction of nationality law under the market conditions. Mainly this should begin from estabishing the law economically ,educationally and set up its authority and compulsion to perfect itself.
